Kim, if the Modern Worker Empowerment Act passes in Congress, will it supersede CA's abomination of a law that has put so many freelancers out of business? Will it restore freedom to those in NY state whose livelihoods are suffering under the Freelance Isn't Free act?
The Modern Worker Empowerment Act is specific to federal law. When I testified before Congress last month, I mentioned California several times (as well as what's happening right now in my home state of New Jersey) and urged Congress to add state pre-emption to the federal bill, to stop the freelance busting in all the states too. I am no the first person to ask Congress to do this. But as the bill is written right now, it is not going to help us in the states.
Congresswoman Elise Stefanik of New York has signed on as a co-sponsor. She has stood up for us a long time now, prior to this bill as well. Call her office and ask them to help add pre-emption of state IC laws to the bill.

That's so disappointing. I'm in NY, and I was hoping that federal law would be preeminent over our lousy state law.
